Se o \u00c1rbitro assinar um contrato de Administra\u00e7\u00e3o de Aluguel de F\u00e9rias para administrar a propriedade de aluguel de f\u00e9rias do \u00c1rbitro (a \u201cPropriedade Indicada\u201d) dentro de seis meses ap\u00f3s o Agente Imobili\u00e1rio enviar o nome e as informa\u00e7\u00f5es de contato do \u00c1rbitro \u00e0 Cielo Stays, e todos os termos e condi\u00e7\u00f5es do Programa forem cumprido, a Cielo Stays pagar\u00e1 um valor de indica\u00e7\u00e3o do seguinte ao Corretor de Im\u00f3veis referente 30 dias ap\u00f3s a Propriedade Indicada estar dispon\u00edvel para receber reservas atrav\u00e9s do site cielostays.com.<\/p>\n

Elegibilidade<\/strong>: O Programa est\u00e1 dispon\u00edvel para licenciados imobili\u00e1rios em situa\u00e7\u00e3o regular que possuam uma licen\u00e7a imobili\u00e1ria ativa em uma jurisdi\u00e7\u00e3o nos Estados Unidos (um \u201cAgente Imobili\u00e1rio\u201d).<\/p>\n

<\/p>\n

Defini\u00e7\u00e3o do \u201c\u00c1rbitro\u201d do Programa.<\/strong> Um \u201c\u00c1rbitro\u201d \u00e9 uma pessoa indicada que (1) possui uma propriedade que \u00e9 usada ou seria apropriada para uso como aluguel por temporada e (2) n\u00e3o est\u00e1 no momento da inscri\u00e7\u00e3o j\u00e1 sob contrato com a Cielo Stays (ou com um antecessor no interesse de, ou cedente de um contrato com a Cielo Stays) para servi\u00e7os de aluguel por temporada e ainda n\u00e3o esteja envolvido em discuss\u00f5es com a Cielo Stays sobre uma administra\u00e7\u00e3o de aluguel por temporada, desde que um \u00c1rbitro possa ser o comprador de um im\u00f3vel que esteja sob gest\u00e3o da Cielo Stays caso o Agente Imobili\u00e1rio represente o comprador na opera\u00e7\u00e3o de compra do im\u00f3vel.<\/p>\n

<\/p>\n

Limita\u00e7\u00f5es Geogr\u00e1ficas de Pagamento por Indica\u00e7\u00e3o<\/strong>. Exceto quando permitido por lei, um pagamento por indica\u00e7\u00e3o n\u00e3o \u00e9 pag\u00e1vel a um Agente Imobili\u00e1rio ou Corretor pela indica\u00e7\u00e3o de uma propriedade em uma jurisdi\u00e7\u00e3o na qual o Agente Imobili\u00e1rio n\u00e3o esteja licenciado.<\/p>\n

<\/p>\n

Divulga\u00e7\u00e3o<\/strong>. O Agente Imobili\u00e1rio n\u00e3o deve enviar uma refer\u00eancia por meio do Formul\u00e1rio, a menos que o Indicador tenha conhecimento da refer\u00eancia na medida exigida pela lei aplic\u00e1vel.<\/p>\n

<\/p>\n

<\/p>\n

Compensa\u00e7\u00e3o de indica\u00e7\u00e3o paga \u00e0 corretora ou empresa<\/strong>. Qualquer compensa\u00e7\u00e3o por indica\u00e7\u00e3o ser\u00e1 paga ao corretor ou empresa do Agente Imobili\u00e1rio.<\/p>\n

Divulga\u00e7\u00e3o de identidade:<\/em> A Cielo Stays poder\u00e1 divulgar ao \u00c1rbitro a identidade do Corretor de Im\u00f3veis que encaminhou a indica\u00e7\u00e3o \u00e0 Cielo Stays.<\/p>\n

<\/p>\n

V\u00e1rios propriet\u00e1rios, v\u00e1rias propriedades e v\u00e1rias refer\u00eancias.<\/em> Se uma Propriedade Indicada tiver mais de um propriet\u00e1rio, apenas um propriet\u00e1rio ser\u00e1 tratado como Indicado para fins do Programa. Ap\u00f3s uma indica\u00e7\u00e3o inicial do Indicado, voc\u00ea pode ganhar uma compensa\u00e7\u00e3o adicional por indica\u00e7\u00e3o para cada propriedade separada adicional de propriedade do Indicado se o Indicado assinar um contrato com a Cielo Stays para administrar essa propriedade. Essas refer\u00eancias adicionais podem acontecer de uma s\u00f3 vez ou ao longo do tempo. Se mais de uma pessoa indicar o mesmo Indicado (ou co-propriet\u00e1rio de uma Propriedade Indicada com um Indicado) para a Cielo Stays, a pessoa que a Cielo Stays determinar de boa f\u00e9 foi a primeira a enviar o Formul\u00e1rio do Propriet\u00e1rio para a Cielo Stays<\/p>\n

Documenta\u00e7\u00e3o Necess\u00e1ria para Pagamento<\/em>. Para receber um pagamento por refer\u00eancia , voc\u00ea deve preencher um W-9 e um Formul\u00e1rio de Autoriza\u00e7\u00e3o de Pagamento. Se voc\u00ea deseja receber um cheque em vez de um dep\u00f3sito direto de fundos, um endere\u00e7o de correspond\u00eancia deve ser inclu\u00eddo no W9. Se desejar receber o pagamento por dep\u00f3sito direto, \u00e9 necess\u00e1ria uma c\u00f3pia de um cheque sem efeito ou uma carta do banco confirmando o encaminhamento e o n\u00famero da conta.<\/p>\n

Consequ\u00eancias Fiscais. O Agente Imobili\u00e1rio \u00e9 respons\u00e1vel pelas consequ\u00eancias fiscais, se houver, decorrentes do recebimento da compensa\u00e7\u00e3o por indica\u00e7\u00e3o.<\/p>\n

Divisibilidade<\/em>. Se qualquer disposi\u00e7\u00e3o dos termos e condi\u00e7\u00f5es dos Programas for considerada inv\u00e1lida ou inexequ\u00edvel, a validade e aplicabilidade das partes restantes n\u00e3o ser\u00e3o afetadas.<\/p>\n

Boa f\u00e9.<\/em> A Cielo Stays pode reter ou se recusar a pagar uma indica\u00e7\u00e3o se acreditar que um Corretor de Im\u00f3veis est\u00e1 agindo de m\u00e1-f\u00e9 ou contr\u00e1rio \u00e0 inten\u00e7\u00e3o do Programa, por exemplo, ao enviar nomes de propriet\u00e1rios com os quais a pessoa que indicou n\u00e3o tem nenhum parentesco.<\/p>\n

<\/p>\n

<\/p>\n

Altera\u00e7\u00f5es e Rescis\u00e3o ou Suspens\u00e3o do Programa. A Cielo Stays pode fazer altera\u00e7\u00f5es nestes termos e condi\u00e7\u00f5es, ou suspender ou rescindir o Programa, a qualquer momento sem aviso pr\u00e9vio, desde que, na medida permitida por lei, a Cielo Stays honrar\u00e1 qualquer indica\u00e7\u00e3o que tenha se qualificado totalmente para um pagamento por indica\u00e7\u00e3o conforme da data em que a altera\u00e7\u00e3o, suspens\u00e3o ou rescis\u00e3o entrar em vigor. Caso a Cielo Stays modifique estes termos, as altera\u00e7\u00f5es ser\u00e3o publicadas na Landing Page e entrar\u00e3o em vigor ap\u00f3s a publica\u00e7\u00e3o. A participa\u00e7\u00e3o continuada nos Programas ap\u00f3s qualquer modifica\u00e7\u00e3o constituir\u00e1 consentimento para tal modifica\u00e7\u00e3o.<\/p>\n

Funcion\u00e1rios; Autorrefer\u00eancias<\/em>. Funcion\u00e1rios da Cielo Stays n\u00e3o s\u00e3o eleg\u00edveis para participar do Programa. Um Corretor de Im\u00f3veis n\u00e3o \u00e9 eleg\u00edvel para um B\u00f4nus de Indica\u00e7\u00e3o por indicar a si mesmo para a Cielo Stays.<\/p>\n

Except as otherwise permitted by law, a referral payment is not payable to a Real Estate Agent or Broker for the referral of a property in a jurisdiction in which the Real Estate Agent is not licensed.<\\\/p>\\n<p><!-- \\\/wp:paragraph --><\\\/p>\\n<p><!-- wp:paragraph --><\\\/p>\\n<p><strong>Disclosure<\\\/strong>. Real Estate Agent shall not submit a referral through the Form unless Referee has knowledge of the referral to the extent required by applicable law.<\\\/p>\\n<p><!-- \\\/wp:paragraph --><\\\/p>\\n<p><!-- wp:paragraph --><\\\/p>\\n<p><strong>Referral Compensation Paid to Brokerage or Firm<\\\/strong>. Any referral compensation will be paid to the Real Estate Agent\\u2019s broker or firm.<\\\/p>\\n<p><!-- \\\/wp:paragraph --><\\\/p>\\n<p><!-- wp:paragraph --><\\\/p>\\n<p><strong>Additional Terms and Conditions<\\\/strong><br><em>Identity Disclosure:<\\\/em> Cielo Stays may disclose to the Referee the identity of the Real Estate Agent who submitted the referral to Cielo Stays.<\\\/p>\\n<p><!-- \\\/wp:paragraph --><\\\/p>\\n<p><!-- wp:paragraph --><\\\/p>\\n<p><em>Multiple Owners, Multiple Properties, and Multiple Referrals.<\\\/em> If a Referred Property has more than one owner, only one owner will be treated as a Referee for purposes of the Program. After an initial referral of the Referee, you may earn additional referral compensation for each additional separate property owned by the Referee if the Referee signs a contract with Cielo Stays to manage that property. These additional referrals can happen all at once or over time. If more than one person refers the same Referee (or co-owner of a Referred Property with a Referee) to Cielo Stays, The person who Cielo Stays determines in good faith was the first to submit the Owner Form to Cielo Stays<\\\/p>\\n<p><!-- \\\/wp:paragraph --><\\\/p>\\n<p><!-- wp:paragraph --><\\\/p>\\n<p><em>Documentation Required for Payment<\\\/em>. In order to receive a referral payment , you must complete a W-9 and Payment Authorization Form. If you wish to receive a check versus a direct deposit of funds, a mailing address should be included in the W9. If you would like to receive payment via direct deposit, a copy of a voided check or a bank letter confirming the routing and account number is required.<\\\/p>\\n<p><!-- \\\/wp:paragraph --><\\\/p>\\n<p><!-- wp:paragraph --><\\\/p>\\n<p>Tax Consequences. The Real Estate Agent is responsible for the tax consequences, if any, that arise out of receipt of referral compensation.<\\\/p>\\n<p><!-- \\\/wp:paragraph --><\\\/p>\\n<p><!-- wp:paragraph --><\\\/p>\\n<p><em>Severability<\\\/em>. If any provision of the terms and conditions for the Programs is held to be invalid or unenforceable, the validity and enforceability of the remaining portions shall not be affected.<\\\/p>\\n<p><!-- \\\/wp:paragraph --><\\\/p>\\n<p><!-- wp:paragraph --><\\\/p>\\n<p><em>Good Faith.<\\\/em> Cielo Stays may withhold or refuse to pay a referral if it believes that a Real Estate Agent is acting in bad faith or contrary to the intent of the Program, for example, by submitting names of owners to which the referring person has no relationship.<\\\/p>\\n<p><!-- \\\/wp:paragraph --><\\\/p>\\n<p><!-- wp:paragraph --><\\\/p>\\n<p>Changes to, and Termination or Suspension of, Program. Cielo Stays may make changes to these terms and conditions, or suspend or terminate the Program, at any time without prior notice, provided however that to the extent permitted by law, Cielo Stays will honor any referral that has fully qualified for a referral payment as of the date the change, suspension, or termination takes effect.
