Admissibilit\u00e9<\/strong>: Le programme est disponible pour les titulaires de licence immobili\u00e8re en r\u00e8gle qui d\u00e9tiennent une licence immobili\u00e8re active dans une juridiction des \u00c9tats-Unis (un \u00ab\u00a0agent immobilier\u00a0\u00bb).<\/p>\n

<\/p>\n

D\u00e9finition de \u00ab R\u00e9f\u00e9rent \u00bb pour le Programme.<\/strong> Un \u00ab r\u00e9f\u00e9rent \u00bb est une personne r\u00e9f\u00e9r\u00e9e qui (1) poss\u00e8de une propri\u00e9t\u00e9 qui est utilis\u00e9e comme, ou serait appropri\u00e9e pour une utilisation comme, une location de vacances, et (2) n'est pas au moment de la soumission d\u00e9j\u00e0 sous contrat avec Cielo Stays (ou avec un pr\u00e9d\u00e9cesseur int\u00e9ress\u00e9 ou c\u00e9dant d'un contrat \u00e0 Cielo Stays) pour des services de location de vacances et n'est pas d\u00e9j\u00e0 engag\u00e9 dans des discussions avec Cielo Stays au sujet d'une gestion de location de vacances, \u00e0 condition toutefois qu'un Arbitre puisse \u00eatre l'acheteur d'un propri\u00e9t\u00e9 sous la gestion de Cielo Stays si l'agent immobilier a repr\u00e9sent\u00e9 l'acheteur dans la transaction d'achat immobilier.<\/p>\n

<\/p>\n

Limitations g\u00e9ographiques des paiements de parrainage<\/strong>. Sauf autorisation contraire de la loi, un paiement de recommandation n'est pas payable \u00e0 un agent immobilier ou \u00e0 un courtier pour la recommandation d'une propri\u00e9t\u00e9 dans une juridiction dans laquelle l'agent immobilier n'est pas autoris\u00e9.<\/p>\n

<\/p>\n

Divulgation<\/strong>. L'agent immobilier ne doit pas soumettre de r\u00e9f\u00e9rence via le formulaire \u00e0 moins que le r\u00e9f\u00e9rent n'ait connaissance de la r\u00e9f\u00e9rence dans la mesure requise par la loi applicable.<\/p>\n

<\/p>\n

Indemnit\u00e9 de recommandation vers\u00e9e \u00e0 une maison de courtage ou \u00e0 une entreprise<\/strong>. Toute r\u00e9mun\u00e9ration de recommandation sera vers\u00e9e au courtier ou \u00e0 la firme de l'agent immobilier.<\/p>\n

<\/p>\n

Plusieurs propri\u00e9taires, plusieurs propri\u00e9t\u00e9s et plusieurs r\u00e9f\u00e9rences.<\/em> Si une propri\u00e9t\u00e9 recommand\u00e9e a plus d'un propri\u00e9taire, un seul propri\u00e9taire sera consid\u00e9r\u00e9 comme un r\u00e9f\u00e9rent aux fins du programme. Apr\u00e8s une recommandation initiale du R\u00e9f\u00e9rent, vous pouvez gagner une compensation de r\u00e9f\u00e9rence suppl\u00e9mentaire pour chaque propri\u00e9t\u00e9 distincte suppl\u00e9mentaire d\u00e9tenue par le R\u00e9f\u00e9r\u00e9 si le R\u00e9f\u00e9r\u00e9 signe un contrat avec Cielo Stays pour g\u00e9rer cette propri\u00e9t\u00e9. Ces renvois suppl\u00e9mentaires peuvent se produire en une seule fois ou au fil du temps. Si plusieurs personnes r\u00e9f\u00e8rent le m\u00eame r\u00e9f\u00e9rent (ou copropri\u00e9taire d'une propri\u00e9t\u00e9 r\u00e9f\u00e9r\u00e9e avec un r\u00e9f\u00e9rent) \u00e0 Cielo Stays, la personne que Cielo Stays d\u00e9termine de bonne foi a \u00e9t\u00e9 la premi\u00e8re \u00e0 soumettre le formulaire de propri\u00e9taire \u00e0 Cielo Stays<\/p>\n

Documents requis pour le paiement<\/em>. Afin de recevoir un paiement de parrainage, vous devez remplir un W-9 et un formulaire d'autorisation de paiement. Si vous souhaitez recevoir un ch\u00e8que plut\u00f4t qu'un d\u00e9p\u00f4t direct de fonds, une adresse postale doit \u00eatre incluse dans le W9. Si vous souhaitez recevoir un paiement par d\u00e9p\u00f4t direct, une copie d'un ch\u00e8que annul\u00e9 ou une lettre de la banque confirmant l'acheminement et le num\u00e9ro de compte est requise.<\/p>\n

Cons\u00e9quences fiscales. L'agent immobilier est responsable des cons\u00e9quences fiscales, le cas \u00e9ch\u00e9ant, qui d\u00e9coulent de la r\u00e9ception de l'indemnit\u00e9 de recommandation.<\/p>\n

Divisibilit\u00e9<\/em>. Si une disposition des termes et conditions des programmes est jug\u00e9e invalide ou inapplicable, la validit\u00e9 et l'applicabilit\u00e9 des parties restantes ne seront pas affect\u00e9es.<\/p>\n

Bonne foi.<\/em> Cielo Stays peut retenir ou refuser de payer un parrainage s'il estime qu'un agent immobilier agit de mauvaise foi ou contrairement \u00e0 l'intention du programme, par exemple, en soumettant des noms de propri\u00e9taires avec lesquels le parrain n'a aucun lien.<\/p>\n

<\/p>\n

Modifications et r\u00e9siliation ou suspension du programme. Cielo Stays peut apporter des modifications \u00e0 ces termes et conditions, ou suspendre ou r\u00e9silier le programme, \u00e0 tout moment et sans pr\u00e9avis, \u00e0 condition toutefois que dans la mesure permise par la loi, Cielo Stays honorera toute recommandation qui s'est pleinement qualifi\u00e9e pour un paiement de recommandation comme de la date \u00e0 laquelle la modification, la suspension ou la r\u00e9siliation prend effet. Si Cielo Stays modifie ces conditions, les modifications seront publi\u00e9es sur la page d'accueil et entreront en vigueur d\u00e8s leur publication. La poursuite de la participation aux programmes apr\u00e8s toute modification constituera un consentement \u00e0 cette modification.<\/p>\n

Except as otherwise permitted by law, a referral payment is not payable to a Real Estate Agent or Broker for the referral of a property in a jurisdiction in which the Real Estate Agent is not licensed.<\\\/p>\\n<p><!-- \\\/wp:paragraph --><\\\/p>\\n<p><!-- wp:paragraph --><\\\/p>\\n<p><strong>Disclosure<\\\/strong>. Real Estate Agent shall not submit a referral through the Form unless Referee has knowledge of the referral to the extent required by applicable law.<\\\/p>\\n<p><!-- \\\/wp:paragraph --><\\\/p>\\n<p><!-- wp:paragraph --><\\\/p>\\n<p><strong>Referral Compensation Paid to Brokerage or Firm<\\\/strong>. Any referral compensation will be paid to the Real Estate Agent\\u2019s broker or firm.<\\\/p>\\n<p><!-- \\\/wp:paragraph --><\\\/p>\\n<p><!-- wp:paragraph --><\\\/p>\\n<p><strong>Additional Terms and Conditions<\\\/strong><br><em>Identity Disclosure:<\\\/em> Cielo Stays may disclose to the Referee the identity of the Real Estate Agent who submitted the referral to Cielo Stays.<\\\/p>\\n<p><!-- \\\/wp:paragraph --><\\\/p>\\n<p><!-- wp:paragraph --><\\\/p>\\n<p><em>Multiple Owners, Multiple Properties, and Multiple Referrals.<\\\/em> If a Referred Property has more than one owner, only one owner will be treated as a Referee for purposes of the Program. After an initial referral of the Referee, you may earn additional referral compensation for each additional separate property owned by the Referee if the Referee signs a contract with Cielo Stays to manage that property. These additional referrals can happen all at once or over time. If more than one person refers the same Referee (or co-owner of a Referred Property with a Referee) to Cielo Stays, The person who Cielo Stays determines in good faith was the first to submit the Owner Form to Cielo Stays<\\\/p>\\n<p><!-- \\\/wp:paragraph --><\\\/p>\\n<p><!-- wp:paragraph --><\\\/p>\\n<p><em>Documentation Required for Payment<\\\/em>. In order to receive a referral payment , you must complete a W-9 and Payment Authorization Form. If you wish to receive a check versus a direct deposit of funds, a mailing address should be included in the W9. If you would like to receive payment via direct deposit, a copy of a voided check or a bank letter confirming the routing and account number is required.<\\\/p>\\n<p><!-- \\\/wp:paragraph --><\\\/p>\\n<p><!-- wp:paragraph --><\\\/p>\\n<p>Tax Consequences. The Real Estate Agent is responsible for the tax consequences, if any, that arise out of receipt of referral compensation.<\\\/p>\\n<p><!-- \\\/wp:paragraph --><\\\/p>\\n<p><!-- wp:paragraph --><\\\/p>\\n<p><em>Severability<\\\/em>. If any provision of the terms and conditions for the Programs is held to be invalid or unenforceable, the validity and enforceability of the remaining portions shall not be affected.<\\\/p>\\n<p><!-- \\\/wp:paragraph --><\\\/p>\\n<p><!-- wp:paragraph --><\\\/p>\\n<p><em>Good Faith.<\\\/em> Cielo Stays may withhold or refuse to pay a referral if it believes that a Real Estate Agent is acting in bad faith or contrary to the intent of the Program, for example, by submitting names of owners to which the referring person has no relationship.<\\\/p>\\n<p><!-- \\\/wp:paragraph --><\\\/p>\\n<p><!-- wp:paragraph --><\\\/p>\\n<p>Changes to, and Termination or Suspension of, Program. Cielo Stays may make changes to these terms and conditions, or suspend or terminate the Program, at any time without prior notice, provided however that to the extent permitted by law, Cielo Stays will honor any referral that has fully qualified for a referral payment as of the date the change, suspension, or termination takes effect. If Cielo Stays modifies these terms, the changes will be posted on the Landing Page and will be effective upon posting.
