Un participante obtendr\u00e1 un pago por recomendaci\u00f3n cuando un propietario recomendado firme un acuerdo de administraci\u00f3n de alquileres vacacionales y la propiedad est\u00e9 disponible para recibir reservas en el sitio cielostays.com. Su participaci\u00f3n en el programa est\u00e1 sujeta a estos t\u00e9rminos y condiciones. Un Agente de Bienes Ra\u00edces con una licencia activa puede participar en la Programa<\/em> enviando el nombre y la informaci\u00f3n de contacto (direcci\u00f3n de correo electr\u00f3nico, n\u00famero de tel\u00e9fono y\/o direcci\u00f3n postal) de un posible propietario (Referido) a trav\u00e9s del Formulario de recomendaci\u00f3n de propietario. <\/p>\n

Solo las Propiedades Recomendadas en los Estados Unidos y en las \u00e1reas donde opera Cielo Stays son elegibles para el Programa.<\/p>\n

<\/p>\n

Elegibilidad<\/strong>: El Programa est\u00e1 disponible para los licenciatarios de bienes ra\u00edces con buena reputaci\u00f3n que tengan una licencia de bienes ra\u00edces activa en una jurisdicci\u00f3n de los Estados Unidos (un "Agente de Bienes Ra\u00edces").<\/p>\n

<\/p>\n

Definici\u00f3n de \u201c\u00c1rbitro\u201d para el Programa.<\/strong> Un "Referido" es una persona recomendada que (1) es propietaria de una propiedad que se utiliza como alquiler vacacional, o que ser\u00eda apropiada para su uso, y (2) al momento de la presentaci\u00f3n no tiene un contrato con Cielo Stays (o con un antecesor en inter\u00e9s de, o cedente de un contrato a, Cielo Stays) para servicios de alquiler de vacaciones y no est\u00e1 ya en conversaciones con Cielo Stays sobre la administraci\u00f3n de un alquiler de vacaciones, siempre que un Recomendado pueda ser el comprador de un propiedad que est\u00e1 bajo la administraci\u00f3n de Cielo Stays si el Agente de Bienes Ra\u00edces represent\u00f3 al comprador en la transacci\u00f3n de compra de bienes ra\u00edces.<\/p>\n

<\/p>\n

Limitaciones geogr\u00e1ficas del pago por recomendaci\u00f3n<\/strong>. Salvo que la ley permita lo contrario, no se debe pagar un pago por referencia a un Agente o Corredor de Bienes Ra\u00edces por la referencia de una propiedad en una jurisdicci\u00f3n en la que el Agente de Bienes Ra\u00edces no tiene licencia.<\/p>\n

<\/p>\n

<\/p>\n

Divulgaci\u00f3n<\/strong>. El agente de bienes ra\u00edces no deber\u00e1 enviar una referencia a trav\u00e9s del formulario a menos que el \u00e1rbitro tenga conocimiento de la referencia en la medida requerida por la ley aplicable.<\/p>\n

<\/p>\n

<\/p>\n

Compensaci\u00f3n por recomendaci\u00f3n pagada al corredor o empresa<\/strong>. Cualquier compensaci\u00f3n por referencia se pagar\u00e1 al corredor o firma del Agente de Bienes Ra\u00edces.<\/p>\n

<\/p>\n

T\u00e9rminos y condiciones adicionales<\/strong>
Divulgaci\u00f3n de identidad:<\/em> Cielo Stays puede revelar al Recomendado la identidad del Agente de Bienes Ra\u00edces que present\u00f3 la referencia a Cielo Stays.<\/p>\n

<\/p>\n

<\/p>\n

M\u00faltiples propietarios, m\u00faltiples propiedades y m\u00faltiples referencias.<\/em> Si una Propiedad recomendada tiene m\u00e1s de un propietario, solo un propietario ser\u00e1 tratado como Recomendado para los fines del Programa. Despu\u00e9s de una recomendaci\u00f3n inicial del Recomendado, puede obtener una compensaci\u00f3n adicional por recomendaci\u00f3n por cada propiedad separada adicional que sea propiedad del Recomendado si el Recomendado firma un contrato con Cielo Stays para administrar esa propiedad. Estas referencias adicionales pueden ocurrir todas a la vez o con el tiempo. Si m\u00e1s de una persona refiere al mismo Recomendado (o copropietario de una Propiedad recomendada con un Recomendado) a Cielo Stays, la persona que Cielo Stays determina de buena fe fue la primera en enviar el Formulario de propietario a Cielo Stays.<\/p>\n

<\/p>\n

Documentaci\u00f3n requerida para el pago<\/em>. Para recibir un pago por recomendaci\u00f3n, debe completar un formulario W-9 y autorizaci\u00f3n de pago. Si desea recibir un cheque en lugar de un dep\u00f3sito directo de fondos, se debe incluir una direcci\u00f3n postal en el W9. Si desea recibir el pago mediante dep\u00f3sito directo, se requiere una copia de un cheque anulado o una carta bancaria que confirme el n\u00famero de ruta y de cuenta.<\/p>\n

<\/p>\n

<\/p>\n

Consecuencias fiscales. El Agente de Bienes Ra\u00edces es responsable de las consecuencias fiscales, si las hubiere, que surjan del recibo de la compensaci\u00f3n por referencia.<\/p>\n

<\/p>\n

<\/p>\n

Divisibilidad<\/em>. Si alguna disposici\u00f3n de los t\u00e9rminos y condiciones de los Programas se considera inv\u00e1lida o inaplicable, la validez y aplicabilidad de las partes restantes no se ver\u00e1n afectadas.<\/p>\n

<\/p>\n

<\/p>\n

Buena fe.<\/em> Cielo Stays puede retener o negarse a pagar una referencia si cree que un Agente de Bienes Ra\u00edces est\u00e1 actuando de mala fe o en contra de la intenci\u00f3n del Programa, por ejemplo, al enviar nombres de propietarios con los que la persona que hace la referencia no tiene ninguna relaci\u00f3n.<\/p>\n

<\/p>\n

<\/p>\n

Cambios y Terminaci\u00f3n o Suspensi\u00f3n del Programa. Cielo Stays puede hacer cambios a estos t\u00e9rminos y condiciones, o suspender o terminar el Programa, en cualquier momento sin previo aviso, siempre y cuando, en la medida en que lo permita la ley, Cielo Stays respetar\u00e1 cualquier referencia que haya calificado completamente para un pago de referencia como de la fecha en que surta efecto el cambio, la suspensi\u00f3n o la rescisi\u00f3n. Si Cielo Stays modifica estos t\u00e9rminos, los cambios se publicar\u00e1n en la p\u00e1gina de inicio y entrar\u00e1n en vigencia al momento de la publicaci\u00f3n. La participaci\u00f3n continua en los Programas despu\u00e9s de cualquier modificaci\u00f3n constituir\u00e1 el consentimiento a dicha modificaci\u00f3n.<\/p>\n

Empleados; Autorreferencias<\/em>. Los empleados de Cielo Stays no son elegibles para participar en el Programa. Un Agente de Bienes Ra\u00edces no es elegible para un Bono de Referencia por recomendarse a s\u00ed mismo a Cielo Stays.<\/p>\n

Except as otherwise permitted by law, a referral payment is not payable to a Real Estate Agent or Broker for the referral of a property in a jurisdiction in which the Real Estate Agent is not licensed.<\\\/p>\\n<p><!-- \\\/wp:paragraph --><\\\/p>\\n<p><!-- wp:paragraph --><\\\/p>\\n<p><strong>Disclosure<\\\/strong>. Real Estate Agent shall not submit a referral through the Form unless Referee has knowledge of the referral to the extent required by applicable law.<\\\/p>\\n<p><!-- \\\/wp:paragraph --><\\\/p>\\n<p><!-- wp:paragraph --><\\\/p>\\n<p><strong>Referral Compensation Paid to Brokerage or Firm<\\\/strong>. Any referral compensation will be paid to the Real Estate Agent\\u2019s broker or firm.<\\\/p>\\n<p><!-- \\\/wp:paragraph --><\\\/p>\\n<p><!-- wp:paragraph --><\\\/p>\\n<p><strong>Additional Terms and Conditions<\\\/strong><br><em>Identity Disclosure:<\\\/em> Cielo Stays may disclose to the Referee the identity of the Real Estate Agent who submitted the referral to Cielo Stays.<\\\/p>\\n<p><!-- \\\/wp:paragraph --><\\\/p>\\n<p><!-- wp:paragraph --><\\\/p>\\n<p><em>Multiple Owners, Multiple Properties, and Multiple Referrals.<\\\/em> If a Referred Property has more than one owner, only one owner will be treated as a Referee for purposes of the Program. After an initial referral of the Referee, you may earn additional referral compensation for each additional separate property owned by the Referee if the Referee signs a contract with Cielo Stays to manage that property. These additional referrals can happen all at once or over time. If more than one person refers the same Referee (or co-owner of a Referred Property with a Referee) to Cielo Stays, The person who Cielo Stays determines in good faith was the first to submit the Owner Form to Cielo Stays<\\\/p>\\n<p><!-- \\\/wp:paragraph --><\\\/p>\\n<p><!-- wp:paragraph --><\\\/p>\\n<p><em>Documentation Required for Payment<\\\/em>. In order to receive a referral payment , you must complete a W-9 and Payment Authorization Form. If you wish to receive a check versus a direct deposit of funds, a mailing address should be included in the W9. If you would like to receive payment via direct deposit, a copy of a voided check or a bank letter confirming the routing and account number is required.<\\\/p>\\n<p><!-- \\\/wp:paragraph --><\\\/p>\\n<p><!-- wp:paragraph --><\\\/p>\\n<p>Tax Consequences. The Real Estate Agent is responsible for the tax consequences, if any, that arise out of receipt of referral compensation.<\\\/p>\\n<p><!-- \\\/wp:paragraph --><\\\/p>\\n<p><!-- wp:paragraph --><\\\/p>\\n<p><em>Severability<\\\/em>. If any provision of the terms and conditions for the Programs is held to be invalid or unenforceable, the validity and enforceability of the remaining portions shall not be affected.<\\\/p>\\n<p><!-- \\\/wp:paragraph --><\\\/p>\\n<p><!-- wp:paragraph --><\\\/p>\\n<p><em>Good Faith.<\\\/em> Cielo Stays may withhold or refuse to pay a referral if it believes that a Real Estate Agent is acting in bad faith or contrary to the intent of the Program, for example, by submitting names of owners to which the referring person has no relationship.<\\\/p>\\n<p><!-- \\\/wp:paragraph --><\\\/p>\\n<p><!-- wp:paragraph --><\\\/p>\\n<p>Changes to, and Termination or Suspension of, Program. Cielo Stays may make changes to these terms and conditions, or suspend or terminate the Program, at any time without prior notice, provided however that to the extent permitted by law, Cielo Stays will honor any referral that has fully qualified for a referral payment as of the date the change, suspension, or termination takes effect. If Cielo Stays modifies these terms, the changes will be posted on the Landing Page and will be effective upon posting.
